Texas’ electric rates are average, compared to the rest of the country, but our usage is among the highest in the nation due to demand for air conditioning during the long, hot summer season. What is a REP? A Retail Electric Provider is a person or corporation, generator, broker, marketer, or any other entity that is licensed by the Public Utility Commission of Texas to sell electricity to end-use customers over regulated transmission or distribution facilities.
What has changed?
In the past, one company provided all parts of your electric service (generation, transmission and distribution, and retail sales). With competition, these parts are separated. Generation, or production of electricity, has already been deregulated, resulting in an ample supply of new, cleaner and efficient power plants throughout Texas.
The actual delivery of electricity across poles and wires to your home or business is called transmission and distribution. These services are provided to you by the local wires company, which is responsible for maintaining the poles and wires, and responding to emergencies and power outages as always. The Public Utility Commission of Texas (PUCT) continues to regulate the delivery of electricity to ensure the safety and reliability of your electric service.
With electric competition, Retail Electric Providers (REP’s) sell electricity to you and provide functions such as customer service and billing. It is important to note that no matter which REP provides service, the PUCT continues to enforce customer protections and regulate the delivery of electricity to ensure it is delivered safely and reliably by the local wires company.

When I sign up with TriEagle Energy, when will the switch happen?
You will begin to receive power from TriEagle Energy after your next regularly scheduled monthly meter reading. Before you are switched, you will receive written confirmation in the mail. You will receive your first electric bill from TriEagle Energy on the following monthly billing cycle.
What will stay the same?
Your current electric utility (TDSP) will continue to deliver your electricity over the same wires and poles but under contract with TriEagle Energy. Your current electric utility will still respond to service interruptions and will continue to maintain the poles and wires. With our strong commitment to Customer Satisfaction, TriEagle Energy will monitor this response to insure you receive high quality service. You will continue to receive the same reliable service you are used to, but at lower rates and with a higher degree of customer service from TriEagle Energy.
What happens when my contract expires?
At the end of your agreement with you will have an opportunity to decide on another term of service with TriEagle Energy.
Will I receive one or two bills a month?
One simple bill. When you switch to TriEagle Energy, you will receive one bill each month just as you do right now.
If I live in a town with a municipal electric company or a rural area with an electric cooperative, can I choose?
The new law exempts municipally owned utilities and electric cooperatives from customer choice unless their governing boards decide to open their markets to competition. You should contact your electric utility or city government for more information.
Will electric service continue to be safe and reliable?
Yes. The Electric Reliability Council of Texas (ERCOT) is responsible for overseeing the development and effective operation of much of the competitive retail market. On June 1, 2001, the ERCOT system began operations as a single control area where the control and reliable operation of the system converted from the existing 10 control areas to ERCOT. As operator of the single control area, ERCOT is responsible for maintaining the reliable supply of electricity to all customers within its region. ERCOT procedures are subject to PUCT oversight and review. The company that delivers electricity to your home or business along the poles and wires (formerly a local electric utility) is also still regulated by the PUCT to ensure the safe and reliable delivery of electricity.
How do I know if a provider is reliable?
All providers must be certified by the Public Utility Commission of Texas in order to sell electricity in Texas. As part of the certification process the provider must submit information to prove their financial, managerial and technical abilities to sell electricity. Certification number 10064 was issued to TriEagle Energy in January 2003.
How much does TriEagle Energy charge for electricity?
TriEagle Energy will be the energy service Value Leader in the deregulated market place. We provide the Common
Sense Solution, i.e. energy and value add services that are cost effective, environmentally sensitive and have a positive
impact on your bottom line.
Do I have a right to cancel?
For Small Commercial Customers whose aggregate monthly demand for all ESI-IDs listed on the Agreement is 50kW or less, you may cancel within 3 federal business days from when you receive your terms of service statement by contacting TriEagle Energy.
If you wish to cancel the Agreement after the three federal business day grace period, and before the expiration of the term of the Agreement, you may do so by providing us with 30 days notice, in writing via e-mail or fax, of your intent to do so. You will be sent a final bill, which will include a cancellation penalty fee of five hundred and fifty dollars ($550) for a twelve (12) month term Agreement; one thousand, one hundred dollars ($1,100) for a twenty-four (24) month term Agreement; and one thousand, six hundred and fifty dollars ($1,650) for a thirty-six (36) month term Agreement unless you are canceling the Agreement because:
i) you have moved to another location; or
ii) TriEagle Energy notifies you of a material change in service terms or conditions, in which case there is no penalty; or
iii) market conditions change and the Agreement allows TriEagle Energy to terminate the Agreement without penalty in response to changing market conditions. In these three cases, there is no termination penalty.
iv) TriEagle Energy has the right to modify or terminate this Agreement, without any penalty, in response to new or changed law, rule, tariff or regulation, or interpretation thereof, or in response to changed market conditions in accordance with the notice provisions contained in this Agreement.
For Customers whose aggregate monthly demand for all ESI-IDs listed on the Agreement is greater than 50kW, please refer to the Terms of Commercial Service, paragraph 7.1(c) for the early term penalty calculation.
